Georgia Dog Bite Laws

In Georgia, you can file a dog bite claim if you were bitten by a dog under the following circumstances:

What is Georgia’s Responsible Dog Owner Act?

Under this act, a dog owner can be held liable when a dog under their control seriously injures a person or animal. 

Under this new law, a dangerous dog is defined as:

  • A dog acts aggressively enough that a person could reasonably believe the dog is a threat
  • Bites and punctures a person’s skin, but doesn’t cause a serious injury
  • Kills another animal while off their property

This law imposes several requirements on the owner of a dangerous dog. The owner of a dangerous dog must:

  • Register their animal, obtaining a dangerous dog certificate within thirty days of moving to the state or ten days of moving to a new jurisdiction within Georgia.
  • Keep their animal in a locked, secure enclosure on their property.
  • Post signs at the entrance of their property warning of a dangerous dog on the premises.
  • Avoid taking the dog off their property, unless the animal is on a six-foot-long leash or locked in a crate.
  • Notify animal control within twenty-four hours if the dangerous dog is on the loose, attacks a person, or dies.

If a dog owner violates these rules, they must give up their animal to law enforcement or animal control and may be faced with misdemeanor charges. Once the owner shows proof of compliance with the rules of owning a dangerous animal, they can retrieve their animal. They will also be required to pay fees to cover the cost of confiscating and housing the animal. The animal must be retrieved within twenty days otherwise the government can euthanize the animal.
