What Is a Family Petition?

A family petition (Form I-130, Petition for Alien Relative) is the first step to helping your relatives immigrate legally to the United States. It establishes a qualifying family relationship with a U.S. citizen or lawful permanent resident and begins the process toward lawful permanent residence.

Family petitions may be filed by:

  • U.S. citizens for their spouse, children, parents, or siblings.
  • Lawful permanent residents (green card holders) for their spouse or unmarried children.

Once approved, the relative can continue through Adjustment of Status (if in the U.S.) or Consular Processing (if abroad).
