Who Qualifies for Cancellation of Removal

Eligibility depends on your immigration history and status:

For non-permanent residents:

  • Continuous presence in the U.S. for at least 10 years.
  • Good moral character.
  • No disqualifying criminal convictions.
  • Exceptional hardship to a U.S. citizen or lawful permanent resident spouse, parent, or child.

For permanent residents:

  • At least 5 years of lawful residency.
  • At least 7 years in the U.S. after admission in any status.
  • No aggravated felony conviction.
