Fulton County Court – Frederick R. Mann Jr of The Law Offices of Matthew C. Hines, LLC successfully resolved a DUI case against a defendant charged with his third DUI in 10 years.

The client had stopped at the side of the interstate after colliding with another vehicle and was found by responding officers clambering up the slope next to the Interstate.

When asked if the car below was his he said no, although his cell phone was found inside. The client smelled of alcohol and his overall condition suggested he was intoxicated.

He was arrested and charged with DUI-Less safe, Reckless Driving, and leaving the scene of an accident.

The case was delayed for almost 5 years when notices to appear came back undelivered after the defendant’s family’s home was razed by the power company and he moved.

Results of the Case

By terms of the plea the defendant pleaded guilty to the DUI and the other 2 charges were dismissed. The defendant was placed on 12 months probation and ordered to:

  • Serve 240 hours of community service
  • complete the Risk reduction program
  • pay a fine of $1000 plus court costs, and
  • attend the MADD Victim Impact lecture.

He was also ordered to undergo an alcohol abuse evaluation and complete any recommended counseling.

The charge carried a minimum 15 days in jail but the defendant had 29 days of jail credit so that much of the sentence was deemed completed.

The defendant’s license will be suspended for 12 months as part of the sentence.
