On the first Tuesday of every month, Georgia banks foreclose on homes. There is a way to stop this from happening. By filing for Chapter 7 or Chapter 13 bankruptcy, you can put the foreclosure on hold. When a debtor files for either type of bankruptcy, the court would issue a “stay”. This means that all creditors are required to stop attempting to receive payment and must stop continuing to take any collection actions per a court order. This includes the mortgage company who has scheduled the foreclosure on your property.
According to Georgia law, the mortgage company is required to send you a certified notice of the foreclosure date. They are also required to list the foreclosure home online or in the newspaper for four weeks prior to foreclosing on the property.

You will also have the option of seeking a loan modification from the mortgage company.
